The Environment Protection Act 2017 comes into effect in Victoria from 1 July 2021.
The changes to the Act are centred around empowering the regulator to investigate businesses as well as providing for higher penalties. The Act is accompanied by the updated Environmental Protection Regulations and Environment Reference Standard which will also comes into effect on 1 July.
Central to the changes is a shift in focus from prescriptions for conduct to a focus on a requirement to “reduce the risk of your activities potentially harming the environment or human health through pollution or waste.”
