As part of the usual remaking of regulations, the NSW Dangerous Goods (Road and Rail Transport) Regulation 2014 is set to be remade. Changes have been proposed that will impact fuel wholesale, transport and associated PCBUs. The changes are open for consultation and comment now.
The Environment Protection Authority (EPA) has reviewed the current Regulation governing the transport of dangerous goods in NSW to ensure it remains effective and up to date and has developed a set of proposed changes.
The Proposed Dangerous Goods (Road and Rail Transport) Regulation 2022 includes changes to strengthen safety, maintenance, inspection, approval and reporting requirements for drivers and transport companies. Language and layout changes also better align with the national dangerous goods Model Laws.
In summary, the key changes include:
- Heavy tank trailers must have an electronic roll stability system (RSS) fitted, maintained and operational, legislating the RSS Determination previously made by the EPA.
- Prohibited routes specified in NSW Road Rules are mirrored, so that the EPA will be able to enforce these route restrictions.
- Prime contractors must notify the EPA within one hour of becoming aware of an incident resulting in a dangerous situation.
- The competent authority may authorise a qualified engineer, NATA accredited laboratory, NSW government agency or statutory body to approve packaging designs
- Licence and other fees under the Regulation are to be adjusted for inflation from 2023-24.
- A person undertaking the maintenance, testing or inspection of a licensed dangerous goods vehicle must maintain the vehicle in accordance with the requirements in the Australian Dangerous Goods Code.
